NOTICE OF PUBLIC HEARING

REGARDING PROPOSED ZONE CHANGE

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Madison County Planning and Zoning Commission at or after the hour of 6:30 p.m. on Wednesday, February 10, 2021, in the Madison County Commissioner Room, 159 East Main, Rexburg, Idaho, 83440, regarding the proposed Zone changes from Agriculture and Transitional Agriculture to a Transitional Agriculture zone on property owned by WJ Bar LLC.

Situated in the state of Idaho, county of Madison, being part of Section 26 & 27, Township 5 North, Range 39 East, of B.M., consisting of approximately 39 acres, being more particularly described as follows:

 

Tract I

Commencing at the West ¼ comer of said Section 26; Thence South 00º 08'12" East, a distance of 927.81 feet to a point; Thence North 89"23'18" West, a distance of 11.32 feet to a rebar with a plastic cap set stamped, "pis 13856" marking the point of beginning; Thence South 89"23'18" East, a distance of 1,332.14 feet to a rebar with a plastic cap set stamped, "pis13856"; Thence South 00°06'44" East, a distance of383.17 feet to a rebar with a plastic cap found; Thence North 89"14'12" West, a distance of 1,320.70 feet to a point; Thence South 89"17'30" West, a distance of9.43 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 00"25'18" West, a distance of379.92 feet to the point of beginning, more or less.

Commencing at the West¼ comer of said Section 26; Thence South 00°08'12" East, a distance of 636.10 feet to a point; Thence North 88"59'24" West, a distance of 12.77 feet to a rebar with a plastic cap set stamped, "pis 13856" marking the point of beginning; Thence South 88"59'24" East, a distance of 1,333.86 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence South 00°06'44" East, a distance of 282.52 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 89°23'18" West, a distance of 1,332.14 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 00°25'18" West, a distance of 291.81 feet to the point of beginning more or less.

Commencing at the West ¼ comer of said Section 26; Thence South 89°47'59" East, a distance of 1,037.12 feet to the point of beginning; Thence South 01°11'32" West, a distance of650.63 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 88°59'24" West, a distance of 1,034.99 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 00°25'18" West, a distance of 691.91 feet to a rebar with a plastic cap

set stamped, "pis 13856"; Thence South 8'°48'48" East, a distance of 1,054.19 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence South 00°07'52" East, a distance of 19.42 feet to the point of beginning, more or less.

Less and excepting from the above described Tracts:

Situated In the state of Idaho, county of Madison, being part of section 27, township 5 north, range 39 east, of B.M., being more particularly described as follows:

Beginning at the West ¼ comer of said Section 26; Thence South 00°08'12" East, a distance of 1,092.74 feet to a point; Thence South 65°17'08" West, a distance of 11.52 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence North 00°25'18" West, a distance of 1153.59 feet to a rebar with a plastic cap set stamped, "pis 13856"; Thence South 87°47'54" East, a distance of 16.23 feet to a point; Thence South 00°08'17" East, a distance of 55.39 feet to the point of beginning, more or less.

 

It is proposed that the above parcel’s zoning be changed, as defined in Madison County Code Book, Part II, Unified Development Code, Chapter 102, Section 102-2, and section 117-60, et seq., regarding factors to consider in changing the Zoning, from Agriculture and Transitional Agriculture to a Transitional Agriculture.

 

At such hearing the Madison County Planning and Zoning Commission will hear all persons, comments and recommendations relative to such proposed Zone changes as set forth herein.

 

Written comments are strongly encouraged, as limited seating is available. Written Correspondence will be accepted in regard to this proposal no later than Wednesday, February 3, 2021, at 4:30 p.m. at the Madison County Planning and Zoning Office, 134 E Main, Suite 208, Rexburg, Idaho 83440.
