NOTICE OF PUBLIC HEARING

Re: PROPOSED ZONE CHANGE FOR EDK PROPERTIES

 

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Madison County Planning and Zoning Commission at or after the hour of 6:30 p.m. on Thursday, August 13, 2020, in the Madison County Commissioner Room, 159 East Main, Rexburg Idaho 83440, regarding a proposed zone change from a Transitional Agriculture Zone to a Commercial Zone on property owned by EDK Properties, located at a portion of the SW4 of the SW4 of section 1, Township 5 North, Range 39 E of the Boise Meridian, Madison County Idaho, on approximately 8.287 acres. The property is further described as follows:

 

COMMENCING AT THE SW CORNER OF SAID SECTION 1, AS FILED FOR RECORT AT INSTRUMENT NO. 197257 IN THE OFFICE OF TH MADISCON COUNTY RECORDER; THENCEN 00°00’07”W ALONG THE WEST LINE OF SAID SECTION A DISTANCE OF 309.50 FEET TO THE NW CORNER OF THE FIRST DESCRIBED PARCEL OF LAND FOUND AT INSTRUMENT NO 187087 IN SIAD MADISON COUNTY RECORDS, BEING THE POINT OF BEGINNING; THENCE ALONG THE SOUTHERLY AND WESTERLY BOUNDARY OF THAT PARCEL OF LAND DEPICTED BY A RECORD OF SURVEY FOUND AT INSTRUMENT NO. 324635 IN SIAD MADISON COUNTY RECORDS FOR THE FOLLOWING COURSES:

  1. S00°17’00’E A DISTANCE OF 78.47 FEET;
  2. S64°48’03” E A DISTANCE OF 432.35 FEET;

THENCE S 30°07’41’W ALONG THE WESTERLY RIGHT-OF-WAY OF THE FRONTAGE ROAD FOR US HIGHWAY NO. 20 A DISTANCE 0F 906.54 FEET; THENCE N 80°29’26”W ALONG THE NORTHERLY BOUNDARY OF SAID PARCEL OF LAND DESCRIBED AT INSTRUMENT NO. 187087 A DISTANCE OF 127.09 FEET TO THE POINT OF BEGINNING; CONTAINING 8.29 ACRES.

 

 

The applicant is proposing that the above parcel’s zone be changed from a Transitional Agriculture Zone to a Commercial Zone Per the Madison County Unified Development Code, Part II, Chapter 102, Section 102-1(2), and Chapter 117, Section 117-54 et seq.

 

At such hearing the Madison County Planning and Zoning Commission will hear all persons and all objections and recommendations relative to such proposed zone change from a Transitional Agriculture Zone to a Commercial Zone. 

 

Written comments will be accepted in regards to this proposal no later than Wednesday, August 5, 2020, at 4:30 p.m. at the Madison County Planning and Zoning Office, 134 East Main, Suite 208, Rexburg, Idaho 83440.
