- Name - The name of this recommending body shall be the Madison County Planning and Zoning Commission.

Purpose - The purpose of this Commission is to promote the health, safety, and general welfare of the citizens of Madison County in the following manner:
- By impartial and uniform administration of the County Zoning Ordinance to all residents without exception.
- By providing and administering a Zoning Ordinance, which promotes the growth and well-being and business and free enterprise of the County and it's population.
- By ensuring adequate public facilities and services are provided to the people.
- By promoting the orderly growth and development of the County through proper interaction with the Board of County Commissioners and other County Departments.
- By ensuring that the development of land is commensurate with the physical characteristics of the land and County Population.
- By examining the Comprehensive Plan for ways to improve it in order to guide the orderly development and prosperity of the county without the unnecessary restriction of the individual landowner.
- By pursuing the mission of Madison County by providing order, protection, and support of its core values of family, community, education, recreation, private property rights, environmental quality, and natural resources while fostering an enticing and welcoming approach to community growth, innovation, entrepreneurial and educational pursuits.

SECTION 2: AMENDMENT “Sec 101-34 Composition” of the Madison County County Code is hereby amended as follows:

Sec 101-34 Composition
The planning and zoning commission shall consist of 12 members. The terms of office for the appointive members shall be between 3 and 6 years. All vacancies shall be filled in the same manner as original appointments.

Sec 101-34 Composition; Terms

Composition - The planning and zoning commission shall consist of not less than three (3) nor more than twelve (12) voting members, with a number set on an as-needed basis by the Board of County Commissioners. . All members shall be appointed by the Chairman of the Board of County Commissioners, and confirmed by a majority vote of the governing board.
- An appointed member of the commission must have resided in the county for at least two (2) years prior to their appointment and must remain a resident of the county during their service on the commission.

Terms - The terms of office for the appointive members
shallmay be up to two (2) three (3) year terms.between3 and 6 years. After the successful service of one term, the appointive member shall be under the review of the governing Board, at which time a second three (3) year term may be appointed confirmed by a majority vote of the governing board. All vacancies shall be filled in the same manner as original appointments.- No person shall serve more than two (2) full consecutive terms without specific concurrence by two-thirds (2/3) of the governing board adopted by motion and recorded in the minutes.

SECTION 3: AMENDMENT “Sec 101-35 Rules; Organization; Meetings” of the Madison County County Code is hereby amended as follows:

Sec 101-35 Rules; Organization; Meetings
- Organization- The commission shall elect a chairman and create and fill any other office that it may deem necessary. A commission may establish subcommittees, advisory committees or neighborhood groups to advise and assist in carrying out the responsibilities of this section.
- Rules, Records, and Meetings - A record of meetings, hearings, resolutions, studies, findings, permits, and actions taken shall be maintained. All meetings and records shall be open to the public.
Meetings of the planning and zoning commission shall be held when duly called by the chair by written or oral notice. At least 1 regular meeting shall be held each month for not less than 9 months in a year. A majority of voting members of the planning and zoning commission shall constitute a quorum. All meetings shall be open to the public. Written rules consistent with this article and the laws of the state for the transaction of business of the commission shall be adopted. Written records of meetings, hearings, resolutions, findings, studies, permits, and actions shall be maintained and open to the public.
